Applicant/Borrower understands that the Applicant/Borrower is seeking to obtain a loan at an interest rate not to exceed ten percent per annum. This loan is to be secured by a motor vehicle owned by Applicant/Borrower and free from any encumbrances such as liens or other security interests. Applicant/Borrower understands that the lender is exempt under the Texas Finance Code from having to be a licensed and regulated lender in accordance with Section 302.001, 341.404 and 342.005.
Applicant/Borrower(s) acknowledges that cashloanstexas.com is providing the Applicant/Borrower with additional and distinct services in connection with this application, in that cashloanstexas.com is providing credit-related services which are articulated and described in a separate Credit Services Agreement that the Applicant/Borrower(s) have entered into with cashloanstexas.com
APPLICANT/BORROWER(S) UNDERSTAND THAT CASHLOANSTEXAS.COM IS NOT THE LENDER. APPLICANT/BORROWER(S) FURTHER ACKNOWLEDGE THAT NEITHER THE LENDER NOR CASHLOANSTEXAS.COM IS A FIDUCIARY. APPLICANT/BORROWER(S) AGREE AND UNDERSTAND THAT ANY LOAN RECEIVED BY APPLICANT/BORROWER(S) FROM THE LENDER MAY NOT BE AT THE BEST INTEREST RATE AVAILABLE AND THAT THE APPLICANT/BORROWER(S) MAY LOOK ELSEWHERE IN ORDER TO OBTAIN A LOAN.
Applicant/Borrower(s) understand that the Applicant/Borrower have agreed to pay cashloanstexas.com for aiding and assisting the Applicant/Borrower in obtaining a loan. This is a separate and distinct service and therefore is provided in exchange for a separate fee. Regarding this separate and distinct service, the Applicant/Borrower(s) voluntarily and willfully choose to use part of the loan being requested to pay for these separate credit services and the Applicant/Borrower(s) understand that this loan will be made by the lender in accordance with Section 302.001 of the Texas Finance Code and that the interest rate on the loan shall not exceed ten percent per annum and that nay credit services fees paid to the credit service organization for arranging the loan shall not be considered interest for purpose of Texas law, but rather are to be treated as a finance charge for purposes of the required federal law disclosures.
For the purposes of filling out the information in the credit application, Applicant/Borrower and any Applicant/Co-Borrower(s) are referred to at times as "you", "your", or "yours."
